Brian Jesus Marquez, 36, of Denton is free on bonds totaling $100,000 after he was charged with two counts of intoxication manslaughter with a motor vehicle in a head-on crash in October on Interstate 35 that killed two Austin musicians.Marquez was released from the Hill County Jail on Oct. 31 after posting the pricey bond.
The accident investigation report says Marquez was driving south on Interstate 35-W near Itasca when his Nissan Armada drifted off the roadway and onto the shoulder. Marquez then over-corrected and drove across the center median, into oncoming northbound traffic where his vehicle struck a 2007 Dodge Caliber.
The Caliber's driver, Bradley Kyle Schroeder, 33, and passenger Chase Monks, 26, both of Austin, were pronounced dead at the scene of the accident near Itasca. They were both members of the band of rising Kyle country performer Bo Cox. They were en route to Fort Worth to prepare for a performance.
As a Drunken Driver Attorney, I see cases like this way too often. My heart goes out to the young men that were killed and I am sure justice will be served on Jesus Marquez. One cannot commit such a serious crime, bail himself out of jail, and expect things to be peachy. I hope Marquez realizes what he did was wrong. Chances are he will not have the opportunity to have a drink or drive for a while. Some possible penalties for intoxication manslaughter are: • Jail time of up to 20 years • Fines of up to $10,000 • Probation and random alcohol testing • Interlock device on vehicle • Alcohol classes • Community service hours typically starting at a minimum of 200 • Revocation or suspension of drivers license
