Texting Out. Reading Texts – In?

Texas House Bill 243 passed last Thursday that would put a ban on texting and driving should the bill be approved by the state senate and the governor.

At first I was elated to here this news; the prevention of distracted driving has been a long-time initiative of my personal injury law firm in Fort Worth.

But when I read the news story a little closer, I was shocked! The bill only bans the act of sending a text message - not reading one.

Sure, this is definitely a step in the right direction. Everyone knows that texting and driving causes car accidents. But isn't reading a text just as dangerous as sending one?

This law is basically unenforceable. How is a police officer supposed to know if you're just reading or if you are actually sending a text?

I'm glad that distracted driving is finally on the table for our Texas legislators to discuss, but I don't think this bill will help much of anything.
