How Do I Start a Claim in Texas with the Other Driver's Insurance Company? | Fort Worth Lawyer FAQ

After you've been in a serious Texas car wreck, you might return home from the crash scene or hospital and wonder, "What now?" 

You have a couple of options. If your injuries are serious and the other driver caused the wreck, I'd highly advise you to call your personal injury attorney. When there are big medical bills and auto damages on the line, it's extremely helpful to have an attorney on your side, making sure you get every last penny you deserve. 

On the other hand, if your injuries are minor and you choose to forgo and attorney, you must first contact the other driver's insurance company to report the claim. (This is, of course, assuming the wreck was their fault). 

Before calling, make sure you have the name of their client and the policy number, if you can manage to get it. (This information is usually exchanged at the accident scene, assuming no one had to be rushed to the hospital). 

What if you didn't get the information at the scene of the accident? Your best bet is to obtain it from the police report, which should have been conducted by a local officer when you called 911 after the accident. Police reports can usually be obtained a few days after the accident (see Obtaining a Police Report).

But what if a report was not done and for whatever reason you didn't get the other driver's insurance information? Then you must locate the other driver and request the information. 

When you call the claim in, be ready for a long call; they'll ask you lots of questions. During this initial call, you should receive a claim number and establish when you should hear back from the adjuster. You must stay on top of this and continue to call if you don't hear back in the time frame quoted.

Be cautious if pursuing compensation by yourself, however, as the insurance agents you will be dealing with are trained and experienced in denying injury claims or settling them for far less than their fair value.
