Is filing a claim with the insurance company enough to preserve your legal right?

In Texas, there is a statute of limitations on all motor vehicle claims. The law requires that you either resolve your case or file a lawsuit at the courthouse within two years from the date of the car crash. Just contacting the insurance company and opening a claim is not sufficient, even if you are dealing with the adjuster on a daily basis—even right up until the statute date. To preserve your legal right, you must actually either have the claim resolved, settled or have someone file your lawsuit at the courthouse by the two year anniversary of the accident. Failure to do so will result in your claim being barred forever.
