Q
Is the Statute of Limitations different for children than it is for adults?

A
Due to the fact that legally children are unable to make decisions for themselves in Texas, the statute of limitations in child injury cases is different that in cases involving adults. Regardless of the child's age at the time of the accident, the statute of limitations is extended until 2 years following the child's 18th birthday, in other words until their 20th birthday.

However - and this is tricky - the medical bills are the parents' responsibility. As such, the parents have to pursue a claim for these expenses with two years of the accident.
