My child was injured day care van accident. Could their injuries be because the day care did not properly restrain them?

Yes. They typical 15-passenger day care van is at a higher risk to roll-over in accidents than regular cars. Because of this, children that are younger than 8 years old or less than 4' 9" should be secured in a child passenger safety seat system if they are riding in a Texas day car van. This change in state law went into effect September 1, 2009 and if your child's day care did not abide by it after that date, it could prove clear negligence and liability in your child's personal injury claim.
