Who is responsible for a car accident when the road conditions are icy?

Although we don't get too much ice in Texas, it does happen and when it does ice or snow, there are always accidents on Fort Worth and Dallas highways. In Texas, icy road conditions are not a defense in a car accident claim. So if somebody rear-ended you when there was ice on the ground, the icy road condition does not count as their defense and you may be able to collect damages from them. The relevant question is whether the person who hit you was negligent. All drivers must take into consideration the icy conditions and must drive accordingly. Ice is not an excuse for an accident.
