Main Issues in Car Accident Cases

There are two main issues which are present in every car wreck case. As written, these issues are very simple, but just about every case has a complex aspect to it. Most of the time, different issues make the answers to these two questions unclear about what to think. The basic issues in car wreck cases are:

  1. Who is responsible (or at fault) in the accident? Sometimes this is as easy as looking at the police report, but oftentimes there needs to be an investigation conducted to figure out who is the "at-fault" party. And who decides this answer?

  2. How should the party not at fault be compensated? There is no set chart to look up in a book to see how you should compensate someone for their injuries. Every case is unique, with different injuries and different treatment results. So who decides how much compensation is fair? And how is this amount determined?
