Every day in the Dallas-Fort Worth area, all kinds of preventable accidents resulting in serious injuries happen to children. Children are often the collateral victims of negligent acts stemming from an array of preventable incidents such as motor vehicle collisions, playground injuries, dog bites, etc. The extent of injuries they are left with range from animal bites, bruises, lacerations and broken bones to the more severe and traumatic burns, disfigurement, and loss of limbs.

While not all injuries to children are the result of negligence by an individual or by an entity, it is not always easy to understand which accidents resulting in injuries are the result of someone else's negligence. In any instance of a child sustaining injury resulting from negligence,  it is our opinion that it is a parental duty and obligation to oversee that a claim is brought forth to compensate their child.

KIDS NEED AN ADVOCATE

Many questions arise as to how a claim can be pursued on behalf of a child. By law, an injured child cannot make this decision. So it is the responsibility of the parent or legal guardian to hire an attorney to bring forth the claim. Since the medical bills are the responsibility of the parents or legal guardian, those persons are also included in the claim. At the conclusion of the claim, the amount attributable to the injured child must be approved by the Judge presiding over the case. The Judge typically appoints an “ad litem” attorney to oversee that the settlement is fair and that the settlement proceeds are apportioned in the best interest of the child. The amount due to compensate the child is either invested in a court-approved annuity or held in a court-approved account, to which the child will have access to when he or she turns 18.
