The Dangers of Distracted Driving

As an Arlington, TX personal injury and wrongful death attorney, I know then any activity which distracts a motorist’s attention from the road ahead could have potentially fatal consequences both for themselves, their passengers and any other road users unfortunate enough to be in the area. Distracted driving could be many things: eating while driving, tuning your dashboard radio, applying makeup, talking to kids in the back seat… However, one of the most common types of distracted driving in DFW involves drivers using their cellphone when they should be concentrating on safe driving.
Over the past decade, cellphones have become more and more common. Today, people use their smartphones to do pretty much everything – to call and text friends, send emails, shop and even update their Facebook or Twitter status. The technology is great – but in the driver’s seat it could be deadly.

Distracted driving experts have classified four different categories of distraction caused by a driver using a cellphone while behind the wheel:
  • Visual Distraction – taking their eyes off the road ahead
  • Auditory Distraction – talking or listening
  • Cognitive Distraction – thinking about something other than the task in hand
  • Manual Distraction – taking their hands off the steering wheel
Even though a completely “hands free” phone may not involve manual distraction, the three other types of distraction are serious enough to be considered negligent behavior while operating a vehicle.
According to the US Department of Transportation (DOT), the odds of a driver reaching for an object while driving being involved in a crash are increased by three times compared to normal driving. The chances of being involved in an accident when dialing a phone are increased by six times.
As an Arlington auto accident lawyer, I have seen the devastation caused by drivers who were distracted by cellphones and other devices. Distracted driving is just as hazardous as drunk driving. Fortunately, in September 2011, the city of Arlington completely banned texting while driving and imposed a $200 fine on drivers who are caught breaking the law. I have no doubt that this will greatly improve public safety throughout Arlington. Unfortunately, however, other cities in the Dallas-Fort Worth metroplex are yet to follow suit.
If you or a loved one is involved in a traffic wreck caused by a distracted driver, I advise you to consult with a good lawyer as soon as possible following the accident. I offer completely free, no obligation consultations to injury victims and their families to help you understand your legal rights and explain what compensation you might be entitled to under Texas law.
