Chances are the only name of an injury attorney you know is one you've seen thousands of times on TV commercials, so let's start there. If you spend any time in front of the television, you get inundated with loud (and sometimes offensive) ads touting the featured attorney as the toughest lawyer in town. These lawyers make the legal process sound lucrative and quick. They try to make it sound as if you're fortunate to be in a wreck, as if all of your financial problems will now magically be solved. Oh, but beware!
I believe most of these television ads are demeaning to my profession. People refer to injury lawyers as "ambulance chasers" and I think it's because of these ridiculous commercials. They make every injury attorney look sleazy and greedy which is why I despise most of these advertisements. Our State Bar has certain advertising regulations, but as long as attorneys who advertise on television don't lie, then the right to free speech prevails. These lawyers are able to flash money and say just about anything they want.
The truth is most television lawyers are running what I like to call "personal injury mills." For those attorneys, it's merely a numbers game. Their practices are based solely on volume; they operate under the mentality of settling each case as fast as they can for whatever the insurance company will offer so they can move on to the next one. That is a disgusting way to run a professional practice.
Furthermore, you'll probably never even meet or speak on the phone with the lawyer you see in the television ad. In fact, those injury mill claims probably won't be handled by a lawyer at all. All of your dealings (if any) will be through a non-lawyer staff member. The big advertising mills hope to settle your case early without expending much effort or time. On the contrary, you are entitled to a lawyer who will personally handle your case. You deserve someone who's invested in your case for the long run, as well as someone who's ready, willing and able to take your case all the way through a jury trial to get you the best possible result.
