Crash Scene Evidence

As a Crowley personal injury lawyer, I know that if you've been involved in a traffic wreck your first priority should be to make sure you receive the appropriate medical attention for any personal injuries you may have sustained through the accident. It is also important that you gather as much evidence as possible to document the scene of the accident as this can make a tremendous difference to the amount of compensation you could receive, whether you are pursuing a personal injury claim or just a property damage claim.

It is always recommended that call the police so that an officer can come out to the scene and complete an accident report. Generally, the insurance company will assume that if a report has not been done, then the crash (and your injuries or the damage to your vehicle) couldn't really have been that serious. A police report is a must. It is a great starting point for your attorney's investigative team and usually contains the reporting officer's adjudication on who the at-fault driver was.

You can also collect as much evidence yourself as possible. This is one of the few times I advocate having a smartphone with you in the car, because they are great for taking photos to document the immediate area. Make sure you take photographs which show damages to your car or motorcycle as well as any other vehicles involved in the collision (it may be the last time you see them), snap shots of any skid marks on the road, any debris which contributed to or resulted from the crash, any injuries immediately after they are cloudy. You should also capture the surrounding area. Where did the collision occur: At an intersection? On the highway? In a parking lot? What is the weather like - it is cloudy, rainy? Take as many photos as possible of anything which could possibly be used as evidence later on.

If and when you decide to pursue a claim, the more information you already have, the better. Proof from the scene of the accident really does show your case in the best possible light, and it can help you get the fairest compensation for your damages.

One of the most common questions a new client has is “What is my case worth?”

The truth is that it is extremely difficult to estimate any injury claim's value until the injured party has ended medical treatment and is either well or as well as he or she is going to get. Only then can you truly put a figure on the damages that should be sought.

There is nothing worse than settling a claim too soon because once you settle, it's final. If your conditions worsen after prematurely accepting a settlement then you have no choice but to pay any additional medical bills yourself. Once your case settles, you cannot force the insurance company to also pay for your medical care in the future.
