  • Manufacturing Defect: A manufacturing defect is just that, one that happens during the manufacturing process and has nothing to do with the actual design of the product. This is not an intended defect, and happens because something went wrong during the manufacturing process.
  • Design Defect: A design defect is inherent to the design of the product. The injury happens based on the way the product was intended to be produced. In an unsafe product case based on design defect, alternative designs will probably be discussed as a way the injury could have been avoided.

Types of consumer goods included in product liability cases include everything from unsafe prescription drugs, to a braking system not working properly in a car, to a toy being poorly designed.

The complicated part of product liability cases is to prove that the defect was caused by the manufacturer, distributer, or wholesaler, and not by the customer. For example, if a car braking system was claimed to not be working correctly, it could be argued that it was the driver's slow response time that led to the crash, and after the collision the car could be in too poor of condition to access the braking system.
