Getting Your Damaged Motorcycle Repaired or Replaced



If you or someone you love has been injured in a Fort Worth motorcycle accident, then it is important that you speak to a board certified personal injury and wrongful death attorney as soon as possible. If you were lucky enough to avoid bodily injuries in your wreck, but are still face with getting your damaged bike either repaired or replaced, you can probably handle your property damage claim alone without the aid of an attorney.

Good evidence makes the claim so take as many photos as you can of the damage to your motorcycle and any other possessions which were destroyed in the collision. If you are able to take photographs of the crash scene too, that will help to reinforce that it was the other motorist who was at fault, meaning that their insurance company is liable.



Even if another driver was responsible for the wreck, you still have a duty to notify your own insurance provider. Sometimes, your own provider will be able to help you speed up the process so that you can get your ride fixed quicker. If you have collision coverage, I recommend that you get your motorcycle repaired on your own insurance and then your provider will claim that money back from the negligent driver’s auto insurance on your behalf. If you have to pay a deductible, you will also get that refunded to you.

You will also have to speak to the negligent driver’s insurance company. Under no circumstances should you give them a recorded statement when they ask you to do so. You have absolutely no legal obligation to do this and it can only end up hurting your claim later on.

If the insurance company determines that the repair costs total more than 80 percent of the vehicle’s fair market value, then it is highly likely that they will declare your motorcycle as totaled. This figure varies for every insurance company, but it’s a good ballpark figure. What this means is that the insurance company will effectively buy your bike off you rather than pay to have it repaired. You do have the option of keeping the motorcycle if it sentimental value or if you want to get it repaired yourself, but this means that you have to pay more money out of your own pocket. It also means that any settlement you receive from the insurance company will be less any salvage money they might have gotten from selling your totaled bike to a scrap yard.

It is also worth noting that simply by virtue of your motorcycle being involved in a traffic wreck, it will suffer inherent diminished value, which basically means it will lose some of its resale value. You may be able to make an additional diminished value claim against the negligent party’s insurance company, but there is a strict deadline of two years from the date of the accident by which you must make such a claim.
