Legal Rights After a Hit and Run Accident

Hit and Run Accidents in DFWIf you have been injured in an accident with a hit and run driver in the Fort Worth, Texas area, you have rights. First of all, theres always the hope that the hit and run driver who caused the motor vehicle collision can be located.

You should immediately report the wreck to local authorities and hopefully the investigating police officers can take whatever information you give them, license plate, car description, etc., and locate the hit and run driver.

But, lets assume that the hit and run driver cannot be found and nobody knows who the coward is that hit you and left the scene. If you have uninsured motorist insurance coverage for the car you were in, then you can make a claim on your uninsured motorist coverage as long as theres contact between the vehicles. Texas law requires there is contact when the identity of the other car is unknown. Now, as long as theres any contact, you can make an uninsured motorist claim on your own policy and you should receive fair compensation from that policy. In fact, thats the reason you bought it. You bought it to protect yourself if the other driver did not have insurance or if the other driver cannot be found.

NOTE: Just because you are making a claim on your own policy, it does not mean that you will be treated fairly. You should, but it usually takes a fight to get your own insurance company to pay you fair value for your injury claim.
