Driving around Hurst's roadways can be a nightmare no matter what vehicle you drive. For a motorcyclist, the daily congestion on 820, 183 and 121 can be extremely hazardous as drivers of cars, pickups and 18 wheeler trucks all routinely fail to watch out for bikes in favor of cutting ahead of other motorists to try and beat the bumper-to-bumper traffic. No matter how safe a rider you might be, you cannot protect yourself from the dangerous idiot who thinks that just because he has a bigger vehicle means he gets right of way. Accidents happen.
Consulting with an experienced personal injury lawyer is essential, and I'd recommend doing so as soon as possible after your wreck. To make things easier for you, I offer completely free consultations to injured bikers, and there is never any commitment to hire me. You may not need an attorney. If you don't have any broken bones or other serious injuries and your medical bills are relatively low, then you will probably be able to handle your claim for compensation on your own just fine. But it's always worth just checking in with someone who has been fighting for the rights of injured motorcyclists since 1991.
Under Texas law, if you've been in a collision that wasn't your fault you are legally entitled to seek compensation to cover all past and future medical expense related to the crash. This includes any doctor or hospital bills, as well as any chiropractic treatment or physical therapy that you need. You can also seek damages to reimburse you for any income you've lost as a result of having to take time off work.
Beware of the insurance adjustor though. Even if the at-fault motorist uses the same insurance company as you, it doesn't mean that they will treat your right. Their singular goal in this situation is to close the case with as little cost to them. If you don't have an attorney to fight in your corner, then they will try to deny or delay your claim. I've had clients in the past who were actually bullied by the insurance company into trying to accept a lowball offer that didn't even come close to covering the debt that they had incurred as a result of the accident.
You shouldn't accept anything less than the full and fair compensation you deserve. Nor should you have to battle the insurance adjustor on your own. You're priority should be to focus on getting better so you can get your life back on track where it should be.
