What County Will My Personal Injury Claim Be Tried In?


Juries in some Texas counties are more likely to be sympathetic to injury victims than those in other counties. Even within a certain county, some judges are more receptive to injury cases than others. Also, Texas has both a state and a federal court system. It's the general belief that injury claims fare better in the state court system. There are federal laws which dictate which cases are required to be in the federal system. If you're suing a non-governmental defendant that's from your own state, then your case will likely be brought in a Texas State District Court. The particular county the lawsuit is brought in depends on the venue laws. For negligence claims, lawsuits are generally filed in the county where the accident occurred or in the defendant's home county. If more than one county can be chosen, it's up to the plaintiff's lawyer to pick the county he or she believes is best for that particular case.
