The major insurance companies operating in America are some of the largest businesses in the entire world. They have grown so large because they are very good at what they do. As long as these insurance companies take in more money in premiums then they pay out to settle claims, then they make a profit. There is nothing wrong with trying to make a profit-we certainly want our law firm to be profitable.
The problem (or one of the problems) with insurance companies is that they try to make their profit by paying the absolute least amount of money out on every single claim, regardless of the claim's merit. Whether your case is a minor "fender bender" or you have tragically lost your child or loved one in a major accident, we can guarantee you one thing: the insurance company will do all that it possibly can to pay you as little as possible for your injury or loss.
Our firm sincerely believes insurance companies operate under a philosophy of putting "profits over people." When you enter the world of personal injury claims, you must be prepared to stand up and go "toe to toe" with these big powerful insurance companies. To achieve a fair result, you must fight and claw for every single dime.
Trying to resolve a personal injury claim is different from just about any other business transaction. In a normal business deal, one party will benefit from the sale and one party will benefit from the purchase. You have both sides working toward a common goal of completing a deal.
Unfortunately, trying to resolve a personal injury claim is a totally different type of transaction. As the injured party, you are obviously trying to obtain money from the insurance company and the insurance company is trying to come up with a reason not to pay you-or at least pay you as little money as possible. There is no common interest at all. This naturally creates a very adversarial process, and there is no way to get around that.
Because it's an adversarial process, the at-fault person's insurance company has no duty to treat you fairly. Absolutely no duty whatsoever! The only protection that you will be afforded is our great American jury system. If an insurance company thinks that you will be awarded money by a jury, then they have an incentive to offer you money. If the insurance company thinks that it will win the case, then you can expect an offer of next to nothing. Just because the insurance company pays to have your car fixed after an accident (which is a no-brainer), it doesn't necessarily mean it will treat you fairly on your bodily injury claim. Believe us, insurance companies don't pay any money unnecessarily and they don't pay at all until they are convinced that it is in their best business interest to do so.
