Use All Available Insurance Policies in Personal Injury Cases


With juries and insurance companies becoming increasingly conservative in their valuations of injury claims, it's more important than ever to make sure that all available insurance policies are explored. The initial step is easy: You start by looking into the responsible party's insurance policy. If that person was on-the-job, then the employer's insurance coverage should come into play. Also, if the responsible party was driving someone else's car, then you need to look to both the car owner's insurance and the permissive driver's insurance.


But don't stop there. As a Fort Worth personal injury lawyer, one common mistake I see people make is not taking advantage of their own car insurance policy. There are two kinds of insurance that you potentially have on your own car that could help you out if you're in an auto accident. If the responsible driver doesn't have insurance or doesn't have enough insurance, then you should definitely make a claim on your own uninsured/underinsured motorist's coverage-if you have it. All Texans are eligible to purchase it, but this kind of coverage is not mandatory. So if you have it-use it!

The other type of insurance that you should take advantage of is Personal Injury Protection (PIP) coverage. Again, this is not mandatory coverage so not everyone pays for it. If you do have PIP, then you should absolutely use it. If the at-fault driver has insurance, you can and should still use your own PIP insurance as well. Even if your medical bills are covered by health insurance, I think you should still use it. By using your PIP coverage, you're simply taking advantage of benefits for which you have been paying premiums year after year.

By the way, if you're a passenger in someone else's car, you can also look at both their policy and your own policy as potentially providing you with additional coverage. Sometimes it's these additional policies that make quite a bit of difference in your overall recovery.
