Pre-Litigation Complete Initial Investigation


Even in cases where I decide not to try for a pre-litigation settlement, I sometimes find it's in my client's best interest to delay filing a lawsuit for a while. The reason is I might need to conduct a thorough investigation before the insurance company conducts their own investigation. Alternatively, if the insurance company doesn't know about a case, they can't do anything to investigate and try to persuade witnesses. Even when I perform initial investigations, it doesn't ever take long before I get anxious to file the lawsuit and get the case moving.

Some people prefer not to hire a lawyer and try to handle their case on their own. While that might work well for minor claims where the dollar value of the claim is very low, in most injury cases it's a foolish decision. It boils down to the fact that you have absolutely no leverage without an attorney. As a non-lawyer, you can only try to resolve your case pre-litigation. Filing a lawsuit is not an option and insurance companies know this. Therefore, you can always expect a "low-ball" offer. There is very little chance an insurance company will pay you even close to fair compensation without at least the threat of a lawsuit.
