Myth #3: The Amount of Your Settlement Should Equal Three Times your Medical Bills


Depending on your type of case and the severity of the injuries suffered, your settlement may or may not exceed this arbitrary "three times" threshold. If you had broken bones or suffered some sort of permanent injury, your total medical bills really have no relation to the value of your case.

On the other hand, if you suffered only soft tissue injuries (i.e. whiplash) and sought chiropractic or physical therapy treatment, it's unlikely you'll receive a settlement (or jury award) of three times your medical bills.

When I started practicing law in 1991, it was common for injured parties to receive a settlement or jury award of three times their medical bills for the most minor injuries. However, since then, juries in Texas have become increasingly more conservative and make accident victims prove more serious injuries before they will award significant compensation.

Of course, every case is different and depending on the facts of your case, you might very well receive compensation of that equals three times your medical expenses, or even more.
