Exceptions to the Statute of Limitations in Fort Worth, Texas

In Texas, we have a 2-year limit of statute of limitations. That means you have to either settle your claim or bring a lawsuit before the 2-year anniversary of your accident in order to get any compensation for your injuries and medical treatments.

That being said, there are a couple of exceptions to this 2-year rule. If you are a minor or if you have a child that's been involved in any sort of accident in Arlington, Bedford or Cedar Hill, they actually have longer to pursue a claim for their injuries. However the medical bills, which are the responsibilities of the parents, are still subject to the very strict 2-year limitations.

So, if your child has been injured, you really can't wait until they're 18 years old to bring an insurance claim. That's because if you do, you would have lost your right to recover all of your child's medical bills and valuable evidence to your insurance claim disappears. Even with the 2-year statute, it's important to pursue a claim diligently and quickly to make sure that all evidence is preserved.

Another exception to the statute of limitations in Texas would be in cases is cases where you don't know you're injured. An example of this would be if a doctor leaves a sponge in your stomach from a surgery. In these rare cases, the statute of limitations is 2 years from the time you discover the problem.
