Unless you can answer "yes" to all three questions with complete certainty, then accepting the initial settlement offer would be a big mistake.

Dirty Trick #3

This is where it starts getting really dirty I'm afraid... The trucking company and their insurance company will find any excuse they can to avoid paying you. This could range from questioning your honesty and the qualifications of your doctor to promising you'll have the money - except that it never arrives. Believe me; they will have no time putting you through a rollercoaster of negative emotions in an attempt to get you to give up. You also need to beware of the fact that in Texas there is a two year statute of limitations. This means you have a deadline of two years from the date of the collision by which you must either have settled your claim or filed a lawsuit. It is not uncommon for the insurance adjustor to keep telling you that the check is in the mail in the hopes that you'll keep waiting until the deadline passes, after which you have no legal options whatsoever.
