What Laws Apply To Truck Drivers With Regard to Texting and Driving?
Texting and driving is a problem across the nation. Everyone knows that texting and driving causes car accidents and can make even the most experienced driver get into wrecks. One group of drivers that have no business texting and driving are truckers. Not only is it extremely dangerous to be driving a huge commercial vehicle while texting, it’s also against the law:
In September 2010, the Federal Motor Carrier Safety Administration banned text messaging while operating a commercial truck or bus. Under 49 CFR 390.5, the definition of texting includes using a mobile communication device to search the internet and e-mailing.
The Federal Motor Carrier Safety Administration recently enacted a ban on all handheld cell phone use for commercial vehicle operators. The ban which is effective January 3, 2012, imposes penalties for drivers violating the ban. Drivers who violate the restriction will face federal civil penalties of up to $2,750 for each offense and disqualification from operating a commercial motor vehicle for multiple offenses. Additionally, states will suspend a driver’s commercial driver’s license after two or more serious traffic violations. Commercial truck and bus companies that allow their drivers to use hand-held cell phones while driving will face a maximum penalty of $11,000. The law does allow a driver to use a hands-free cellphone with one-touch dialing so the driver is allowed to initiate, answer, or terminate a call by touching a single button if the driver does not have to reach for the phone “in a manner that requires a driver to maneuver so that he or she is no longer in a seated driving position restrained by a seat belt.” An example of a violation would be when the cell phone is in the passenger seat and the driver has to lean across the cab in order to retrieve the phone.
According to the Federal Motor Carrier Safety Administration’s research, commercial drivers that are reaching for an object, such as a cell phone, are three times more likely to be involved in a crash or other safety-critical event. Dialing a hand-held cell phone makes it six times more likely that commercial drivers will be involved in a crash or other safety-critical event.
