What We Do For Our Personal Injury Clients


All lawyers handle their cases differently. We can't know exactly how other attorneys and firms operate, but we can tell you what the Anderson Law Firm does for its clients. The Anderson Law Firm makes it a point to devote the time necessary to each case, making sure all avenues are pursued to achieve success for each of our clients. Our ultimate goal is to provide superior legal service to our clients and to see that the best possible results are obtained. While not exclusive, here is a general list of what we do:
  • Meet with each client and go over the accident and injury facts, explain our services, the legal process and what to expect during an injury claim;
  • If necessary, perform an initial investigation, including photographing the accident scene, injuries and property damage to the involved vehicles, interviewing witnesses, etc.;
  • Initiate the claim with the insurance company and confirm that there's insurance coverage in place to cover the accident;
  • Communicate with the insurance adjuster to make sure he or she understands the claim from our viewpoint, the importance of the claim and the severity of the injuries. (It's important that the insurance company sets the necessary reserves so it isn't surprised at the severity of the injuries when it comes time for settlement.);
  • Answer each client's questions regarding medical care. (Sometimes clients need the recommendation of a specialist in a particular area and we are glad to provide those referrals.);
  • If necessary, discuss medical treatment with each client's doctors to ensure we understand their medical problems;
  • Hire experts to help explain and describe the liability and damage issues if either are in dispute;
  • Gather relevant documentation, including: medical bills and records, employment or lost wage information, police reports, etc.;
  • Analyze medical records to see if any additional reports or clarifications are necessary. (Some medical records are incomplete and do not fully explain the extent of each client's injuries.);
  • Analyze each client's insurance policies to see if any additional insurance coverage is available;
  • Analyze any medical lien issues that might be claimed by health insurance companies, hospitals, workers compensation carriers or governmental agencies (depending on the plan, they may have a right to be reimbursed out of any recovery received from a third-party insurance company);
  • Appropriately determine the value of each client's injury claim, considering all of the relevant factors;
  • Evaluate each client's case and decide if an attempt at pre-litigation will be made or if we will go directly into litigation;
  • If we decide to attempt pre-litigation negotiations, prepare a thorough analysis of each client's case to present to the insurance company along with a demand for settlement, followed by negotiations with the insurance adjuster to see if a settlement can be reached without having to file a lawsuit;
  • Research the proper defendant to be named in the lawsuit. (This is especially important when suing corporations who have a parent company or use multiple identities.);
  • Discuss settlement offers with each client and make recommendations on accepting or rejecting any offers made. (It's the client's case and therefore his or her decision whether to accept or reject the offered settlement);
  • Prepare and file the lawsuit with the appropriate court;
  • Arrange for a citation to be issued and have the defendant served with the lawsuit;
  • Prepare and serve written discovery for the defendant to answer;
  • Work with each client on preparing objections and answers to discovery from the other side;
  • Prepare each client for his or her deposition to be taken by the opposing lawyer;
  • Prepare for and depose the other party and any other relevant witnesses;
  • Prepare each client for any medical examinations as required by the court;
  • Hire and work with any expert witnesses needed for the case;
  • Take the depositions of any adverse expert witnesses designated by the other side;
  • Prepare each client's doctors for deposition, should this be requested by the other side's lawyers;
  • Prepare for mediation by submitting any relevant documentary evidence for review by the mediator;
  • Prepare each client for and attend mediation;
  • Prepare court filings to address any discovery disputes;
  • Prepare court documents such as witness lists, jury questions, trial briefs, etc.;
  • Prepare for trial, including working with each client and any witnesses regarding what to expect from a trial proceeding;
  • Create demonstrative aids to use before the jury to help it understand the various issues in each client's case;
  • Organize records to be submitted into evidence;
  • Research and write motions and briefs regarding evidentiary issues;
  • Try the case before a judge or jury over several days or weeks;
  • Analyze the trial record and prepare and file any necessary post-trial motions;
  • After judgment, review the court record to see if any appeals are warranted; and
  • After settlement or judgment, work out any outstanding liens on a case.

Again, this is not an exhaustive list-there are many other things we do. We think the most important part of our job (besides winning your case) is keeping our clients informed throughout the entire process. All of our clients are kept up-to-date on all major developments in each of their cases.
