Many questions arise as to how a claim can be pursued on behalf of a child. By law, an injured child cannot make this decision. So it is the responsibility of the parent or legal guardian to hire an attorney to bring forth the claim. Since the medical bills are the responsibility of the parents or legal guardian, those persons are also included in the claim. At the conclusion of the claim, the amount attributable to the injured child must be approved by the Judge presiding over the case. The Judge typically appoints an "ad litem" attorney to oversee that the settlement is fair and that the settlement proceeds are apportioned in the best interest of the child. The amount due to compensate the child is either invested in a court-approved annuity or held in a court-approved account, to which the child will have access to when he or she turns 18.
