    Car Accidents:

  • Case Killer: Signing a Release Too SoonCase Killer: Signing a Release Too Soon
Case Killer: Signing a Release from the Insurance Company Too Soon

Being involved in an automobile wreck can be devastating. An example: you’re involved in a wreck that’s not your fault. You’re taken by an ambulance to the hospital, you’re in the hospital room and you know you’re going to miss work, you know you’re going to have some medical bills and in walks an insurance adjuster who makes you an offer. It might be something really low, or something on the higher end that sounds reasonable. With bills to pay and worry growing it’s a tempting offer. Be warned you won’t get this money without strings attached.
What happens is the insurance company gives you a release to sign and then they will give you the check. The release is an absolute case killer – it means your case is over. Then you get home receive even more bills and are still treating and realize the settlement you took is much less than what this accident has cost you.  If this happens, it’s too late. Once you sign that release and accept that money early on, there is nothing you can do about it; your case is over. Don’t be tempted by early offers; they are in the best interest of the insurance company. To find out what fair compensation is and what your rights are, you need to contact a Texas board certified personal injury attorney.
  • What is Subrogation? What is Subrogation?
In almost all personal injury claims where there is health insurance, the word subrogation comes up. What is subrogation? Subrogation is a fancy word for when the health insurance company, which pays out for medical expenses, has the right to get reimbursed out of any personal injury claim. To get this right, they have to have this in the health insurance contract. You have to look at this contract to determine how strong this right to reimbursement is in your health insurance contract. Some are very strong, like if your plan is the federally funded ERISA plan. The right of reimbursement is real and it should not be ignored. So if you receive a letter from one of your health insurance carriers or someone they hire, like Ingenix, it's something you need to turnover to your personal injury attorney and let them deal with. That's because at the end of a personal injury claim paying back the health insurance carrier has to be taken into account.
  • Case Killer: Telling the Doctor About Your Injury CaseCase Killer: Telling the Doctor About Your Injury Case
Here at the Anderson Law Firm, we have what we call case killers, or things that our clients do or don't do that can really harm their case. One of these case killers is talking to the doctor about your injury claim. When you're at the doctor or physical therapist, you should focus on your problem, report your injuries and be honest but don't talk about your claim, it looks bad. The insurance company or the jury later on, gets to see these medical records. If you're talking about your claim, it shows that you're focused on money and not on getting better. It's a big no no. So let your lawyer focus on getting the money, you focus on getting better. Don't talk the doctor or any medical professional about your injury claim.
  • Determining Fault In Rear-End Collisions Determining Fault In Rear-End Collisions
    - In Texas, is a rear-end collision automatically the fault of the driver that hit the other?

One question we get asked at the Anderson Law Firm is if rear end collisions are automatically the fault of the driver who actually did the rear-ending from behind. In our experience, 95 percent of the time it is the fault of the behind driver in a rear-end collision. We see rear ends at stoplights, stop signs and when cars are yielding to enter the highway.

Usually the person from behind is responsible for the car accident, but not always. When we see cases where people pull out quickly from a parking lot onto a road and they cause a rear-end accident, it's that persons fault because they should have yielded the right of way. Our Fort Worth injury lawyers look at each case and don't assume anything until we've looked at all the facts and accident reports. Then, our attorneys make an individual assessment of who we think is at fault. So if you've been in a rear-end accident and you want to know our thoughts on if you will be able to receive compensation for your injuries, feel free to give us a call at 817-294-1900

http://www.maafirm.com If you have been involved in a car accident, truck wreck, motorcycle crash, bicycle or pedestrian accident in Texas, there was most likely an accident report filled out by the investigating officer who arrived on scene. Fort Worth accident attorney Mark A. Anderson explains how to read a police report and the importance of this report in determining who is at fault. Watch this video to find out more. If a police officer is at the scene of your accident, there will be a police report filled out by the investigating officer. The officer will interview witnesses and include useful information in this report. The reports typically consist of the names of all parties involved including the drivers and passengers, where the cars were towed, who the insurance companies are, if and where people were taken by ambulance, and other useful information. The police officer usually assigns fault and describes the cause of the accident in box 36 of the two-page report. • Truck and Bus Accidents:

  • What Are The Insurance Requirements For Commercial TrucksWhat Are The Insurance Requirements For Commercial Trucks

There are certain state and federal laws that govern how much insurance coverage a motor vehicle must carry. In Texas the state law is that passenger vehicles must carry at least $30,000 in coverage to cover each person with a limit of $60,000 per accident. What that means if five people are injured in the accident, the most that particular policy will pay out is $60,000 and the most that any one person can get is $30,000 – these are what we call the minimum limits.

There are also federal laws which govern interstate commercial trucks that require them to carry $750,000 in insurance coverage. This may sound like a lot of money and it is, but these trucks with their speed and weight cause catastrophic damage when they are involved in wrecks.

  • Too Good To Be True: Why Taking an Early Settlement Too Good To Be True: Why Taking an Early Settlement

If you’ve been involved in a wreck, there’s a good chance the insurance company will throw some money at you just to get the case to go away. At the Anderson Law Firm, our DFW personal injury attorneys have seen offers as low as $200 and there are certain insurance companies like as All State or Progressive that are notorious for making these early offers. They will come to your house or even your hospital room with a check already made out in exchange for your signature on a release. The problem is if you sign one of these releases and accept the check for the nominal amount of money, your case is over. We get calls from people all the time who have signed a release early on and then try to hire us to pursue more money. But there’s a problem there: once you sign the release your case is over. We understand why people accept this early money: you’re hurt, in a bind and are worried about how you will pay for the doctor. However, don’t be tempted by these low offers. It is an absolute case killer. Our injury lawyers recommend that you wait until you get better and talk to a Texas board certified personal injury lawyer to find out about your rights. You certainly have more rights than just accepting a nominal amount of money; you have the right to fair compensation for your injuries. If you have questions about your legal rights, contact the Anderson Law Firm today at 817-294-1900.

  • Case Killer: Missing a Statute of LimitationsCase Killer: Missing a Statute of Limitations
In Texas, there is a time limit on how long you have to pursue a personal injury case. It's called the statute of limitations and it's two years. It's two years from the date of the accident you either have to have your case settled or a lawsuit filed at the courthouse, otherwise your case is barred. It's an absolute case killer if you wait too long. There have been multiple times here at the Anderson Law Firm we've received calls from people who are either passed the two year period or just coming up to the two year time limit and we're not able to complete our investigation and help them out. It's a terrible phone call that we have to make and tell them that their case is no longer valid, they don't have any rights, they're stuck with all those medical bills, all those lost wages and they'll never get any compensation for their pain and suffering all because of somebody else's negligence. So if you've been involved in a wreck, you can't put this on the backburner. A lot of folks want to wait until they finish their medical treatment before contacting a lawyer and that can be an absolute case killer. You need to make this a priority and not let too much time go by.
  • Case Killer: Giving a Recorded StatementCase Killer: Giving a Recorded Statement
If you've been involved in some sort of accident, you probably want to tell your side of the story. You want to get it out there; you want the responsible party and their insurance company to know that you're right and their wrong. The way to give this story is to let your lawyer, if you've hired one, tell the story for you. Don't be tempted to give a recorded statement to the insurance company. That's because your words will be twisted around and the insurance company with trained professionals will ask you questions in a certain manner to minimize you claim. So you have to be careful; giving a recorded statement can really hurt your claim. If you have questions as to what information to give to the insurance company or how to deal with these requests to give a recorded statement, give us a call. If we can help you we will and if not we can still give you advice on how to handle this delicate situation. However we want you to be careful; giving a recorded statement can eventually kill your case.
  • Case Killer: Gaps in Medical TreatmentCase Killer: Gaps in Medical Treatment
One of the biggest case killers we see here at the Anderson Law Firm is gaps in medical treatment. We understand how these gaps occur: You're going to the doctor for a while, things aren't getting better. So you get frustrated and try to tough it out for a while. But that gap makes it look like to the insurance company and to the jury ultimately if your case is tried that you're well. We see it over and over where someone stops going to the doctor for a while, tries to tough it out and it is an absolute case killer. Stay with your medical care, always follow the advice of your doctors and be consistent; go until the problem is solved. Stopping, hoping things will get better is not a good way to go about things, it can be an absolute case killer.
  • Facebook & Your Personal Injury ClaimFacebook & Your Personal Injury Claim
Can the insurance company use my Facebook posts against me?

You need to be careful with what you post on Facebook if you are pursuing an injury claim. The reason is the insurance company, their attorneys and their adjusters can possibly access this information and whatever you post can and will be used against you. Somehow, some way, the insurance company can twist your Facebook activity to make it look like you're not as hurt as you say you are.

If you are pursuing an injury claim, make your Facebook settings private so the insurance company can't have easy access to it. More importantly - watch what you post on Facebook, because whatever you post can be twisted and turned and used against you.

  • PIP Coverage & Your Truck Accident ClaimPIP Coverage & Your Truck Accident Claim
If you've been involved in a truck accident in Texas, obviously you'll be looking to the truck's insurance company for compensation. But one thing you can't overlook is the PIP coverage - personal injury protection. The way PIP works is it pays you for any medical bills and lost wages up to the amount of coverage. The minimum coverage in Texas that is offered to everyone is $2,500. We see it most commonly at $2,500, $5,000 and even $10,000 in PIP coverage. If you have that kind of coverage and have been involved in a truck accident, you can use that money to help pay your medical bills or maybe your co-pay if you have health insurance in order to get your healthcare started. Any compensation that comes from the trucking company is going to be a ways on down the road because they are going to fight you tooth and nail, so what you need to do is look on your own policy to see that you have PIP coverage that way you can get your treatment started now.
  • How often do I need to come to my injury lawyer's office? How often do I need to come to my injury lawyer's office?
How often do you need to come to your injury lawyer's office?

Actually, not that often. Usually we meet clients at main office in Fort Worth for the initial free consultation where clients interview us, we interview them and see if we're a good match and recover money for their injuries. Assuming a contract is signed, there aren't many more times that the client needs to come to the office. If the case goes to litigation there will be times that we need to meet with our client to discuss discovery matters and prepare them for depositions.

If we have a question, we'll call you or you can call us at any time to schedule a meeting, or we can just hash it out over phone and email. It is all dependent upon the case, but it's not that many times that a client actually has to go to their lawyer's office.

  • Importance of Hiring Attorney in Dealing with Texas Truck Driver Laws Importance of Hiring Attorney in Dealing with Texas Truck Driver Laws
http://www.maafirm.com Truck drivers are held to a different set of laws than other drivers. It is important that truckers abide by these rules and laws in order to protect themselves and innocent motorists on the roads. Texas accident attorney Mark Anderson explains in this video why it is important to hire an attorney when dealing with a truck accident. Truck drivers often get compensated by how many miles they drive. Even though the law gives truck drivers specific rules about how many hours they can drive consecutively without resting, reality is that they will get more money the more they drive. Because truck drivers are enticed to drive longer hours, driver fatigue has become an issue on the roadways. Sometimes, we have seen two sets of logbooks, in which one was fabricated. It is extremely important to hire an experienced attorney if you or a family member has been injured in a Texas truck accident. Mark Anderson, of the Anderson Law Firm, is experienced in dealing with Texas truck accidents. Far too many truck accidents are caused by the amount of hours a trucker drives and driver fatigue. • Motorcycle Accidents:

  • Case Killer: Signing a Medical AuthorizationCase Killer: Signing a Medical Authorization
At the Anderson Law Firm, we get hired by many clients who have already tried to resolve the case on their own. They've dealt with the insurance company, got frustrated and came to us.

One thing that we see that is an absolute case killer is when our clients give a medical authorization to the insurance company. These authorizations are not limited in time or scope and allow the insurance company to get all of your medical records, whether they are related to your accident or not.   The way this can be a case killer is if they find some kind of documentation from another injury and then use that injury against you by saying the wreck their driver caused isn't really what injured you.

The insurance company does not have the right to invade your privacy and get your medical records. So don't give a medical authorization to the insurance company, it can be an absolute case killer.

  • How Giving a Recorded Statement Can Ruin Your CaseHow Giving a Recorded Statement Can Ruin Your Case

If you’ve been involved in an accident, giving a recorded statement early on is something that is often requested. You’re tempted to do it; why not? You want to tell your side of the story and you want to get things moving in the right direction. The problem is that your recorded statement will often be used against you. How does this happen? The person taking the recorded statement is a trained professional. They ask you questions in a way to elicit a certain type of response and attempt to twist your words around by asking you confusing and complicated questions.

Don’t give a recorded statement because you will find your words twisted around and later on if you decide to pursue a personal injury claim those words will be used against you. At the Anderson Law Firm we are opposed to our clients giving a recorded statement. Our clients do, however, have to give depositions but we go over the questions and our attorneys make sure our clients are prepared for those questions.  So if you have a lawyer, or if you don’t be extremely careful about giving a recorded statement; it could just ruin your case.

  • Wrongful Death:

  • Life Insurance and Wrongful Death ClaimsLife Insurance and Wrongful Death Claims
If you receive life insurance proceeds, can you still pursue a wrongful death claim on behalf of a loved one?

Wrongful death claims in Texas are when somebody dies as a result of somebody else’s negligence. The family of the person that died has a right to bring a claim. Sometimes the person that died has life insurance and this family is the beneficiary, or they receive the life insurance proceeds.  So the question comes up, “If you receive life insurance proceeds, can you still pursue a wrongful death claim?”

The answer is absolutely, yes. One has nothing to do with the other. Life insurance is what’s called a collateral source – it has nothing to do with the negligence or accident that caused the death and it is not even admissible should your case go to trial. If you have lost a loved one, if you child or spouse or parent has died as a result of someone else’s negligence, you have the right to bring a wrongful death claim in Texas against the responsible party – even if you have life insurance.

Facebook can absolutely kill your personal injury case. Putting the fun things you do on Facebook can make it look like there are inconsistencies with you injury claim. The insurance company and the defense lawyer can misinterpret your Facebook posts. They will access your Facebook and use your photos and status updates to make it look like you are exaggerating your injury claim. We see it happen all the time and it can be a case killer. So if you're involved in a personal injury claim, put your settings on private and watch what you post. You must assume that the defense attorney and the insurance company will be watching your Facebook for pieces of evidence they can use against you in front of the jury.
  • Case Killer: Exaggerating Your InjuriesCase Killer: Exaggerating Your Injuries
There are many ways that a personal injury claimant can do things to harm their case. One of the worst things you can do is exaggerate your injuries. We don't see this very often, because most people are honest folks who go to the doctor, report their injuries and try to get better.

But every now and then, we see it where someone thinks they can help their case by exaggerating their injuries. Insurance companies, juries and especially doctors are very keen and they can sense when you are exaggerating your injuries - it will be noticed. Don't be tempted to exaggerate your injuries; it's actually a case killer. You can end up recovering no money and stuck with all these medical bills. Don't be tempted to exaggerate your injuries, just stay honest: it's the best way to go.

Plus, if you have already dealt with the insurance company, either their own or the other party's insurance company, bring all the documents they have from the insurance company.  Also, any notes you've kept - phone numbers, claim numbers and addresses - bring any of your personal notes relating to the accident.

  • What If the Police Officer Didn't Write a Report After My Accident? What If the Police Officer Didn't Write a Report After My Accident?
If you've been involved in an accident in Texas, there's a good chance the responding police officer prepared what is called a crash report. But in many cases, the police officer for a multitude of reasons does not complete a police report. In that situation, can you still pursue a civil claim against the responsible party?

The answer is yes. Usually if an accident report is not prepared you are given a blue form, which is an exchange of information. We encourage you to do that, fill out that form and send it in. It memorializes that the wreck occurred. At that time, when you exchange it, you end up with the other side's name, address and insurance information. The only down side to not having a police report is that you don't have the crash report to document who is at fault. But that is ok, a claim can still be pursued for your pain and suffering, medical bills and lost wages.

  • Do I Have To Testify In Court?Do I Have To Testify In Court?
If you've been involved in some kind of accident in Dallas or Fort Worth that wasn't your fault and you decide to pursue a claim, at some point the question will come up "Do I have to testify in court?" The answer to that is it depends.

Most cases, there are attempts to settle the case and put a final resolution to it before a lawsuit is even filed. There are many cases with clear liability where the damages are directly related to the accident that a resolution can be made without filing a lawsuit.

If a lawsuit is filed, then there is testimony given in something called a deposition. A deposition is not in court, it's in your lawyer's office. A deposition is still a formal proceeding where you are sworn to tell the truth, but there isn't a judge and jury present to hear everything you say. If you have to file a lawsuit there is a good chance that you will have to give a deposition, but as far as testifying in court that is only for cases that cannot settle in the litigation process. Most cases do settle in the litigation process and very few go to court where a judge and jury will hear your testimony.

If you have any questions regarding anything related to a lawsuit, please give us a call at 817-294-1900 for a free case consultation.

  • Can I Pursue A Claim Against an Illegal Resident? Can I Pursue A Claim Against an Illegal Resident?

If you've been involved in a motor vehicle accident with an illegal alien, can you purse a claim? The answer is yes, you can pursue a claim. There are a lot of people out there that are not in the United States legally that do have car insurance. There are many car insurance companies that will sell policies to illegal residents, so there is still a good chance that there is insurance available to pay for your medical bills, pain and suffering and lost wages.

These kinds of claims can get a little more difficult if the person flees the country and goes back to wherever they're from. At that point the insurance company that insured this illegal resident can try to deny coverage based upon their guy leaving the country and not cooperating with the insurance. But for the most part, if you've been hit by someone that's illegal and they have insurance file a claim, get compensated and get your life back together.

  • How Do I Pay For the Doctor if I Don’t Have Health Insurance? How Do I Pay For the Doctor if I Don’t Have Health Insurance?
How Do I Pay For the Doctor if I Don't Have Health Insurance?

Many people who have been involved in an accident in Texas don't have health insurance. At the Anderson Law Firm in Fort Worth, we get calls all the time from prospective clients asking us, "What do I do? How do I get to the doctor?"

There are two answers to this problem:

    • You can go to the doctor and pay cash or put it on a credit card and deal with those payments later
    • Or, through a lawyer, you can have the lawyer issue to the medical provider a Letter of Protection

What this letter does is tell the medical provider that a claim is pending and that your bill will be paid at the end of the claim. Not all doctors accept Letters of Protection, but many do. Letters of Protection are great because it allows the person who was not at fault for causing the accident to receive the medical treatment they need.

The Fort Worth personal injury lawyers at the Anderson Law Firm do issue Letters of Protection to medical providers on behalf of our clients who do not have health insurance. If you have any questions regarding Letters of Protection or the claims process in general, please give us a call at 817-294-1900.

  • Can I Pursue A Claim If My Child Was Injured In a School Bus Accident? Can I Pursue A Claim If My Child Was Injured In a School Bus Accident?
If you have a child that's been injured in a school bus accident, you do have a right to pursue a claim, but it's a little bit different than a regular car accident claim.

The state of Texas protects school districts; they have something called sovereign immunity. That means you can't sue the school district unless the state says you can, which Texas says you can sue the school district.

School districts purchase insurance just like any other driver in the state.  The one difference is that state law requires you give notice to the school district of your intent to file a claim within six months of the accident. You still have a two year statute of limitations to pursue the claim, but notice of the claim must be given within six months.

Otherwise, school bus accident claims are handled like any other case involving a motor vehicle collision. We look at who was at fault: was it the school bus driver, or was it the other driver? We've had many cases against school districts where the school bus driver was at fault and we pursue those claims just like any other case. We prove at fault and we prove our clients damages and we're dealing with an insurance claim, just like any other claim.

  • Are My Injuries Serious Enough to Hire an Accident Lawyer? Are My Injuries Serious Enough to Hire an Accident Lawyer?
If you've been hurt in a Texas accident, the question may come up, "Are my injuries serious enough to hire an accident lawyer?"

This depends on the scope and extent of your injuries. If you've broken a bone, or herniated a disc in you back or neck, then the answer is yes. You need a lawyer to fight for you to make sure you get the fair compensation for your injuries.

However, if your injuries aren't obviously serious, then the primary focus becomes on the amount of your medical bills at the end of your treatments. Sometimes that is hard to know upfront because once you're hurt in the accident, you don't know how much your medical bills are going to be and how long you will have to seek treatment.

If you have questions regarding the extent of your injuries and if they are serious enough to hire a lawyer, give the Anderson Law Firm in Fort Worth a call at 817-294-1900. Our lawyers will give you their honest opinion on whether they think you can handle the claim on your own, or if your case can benefit from hiring a personal injury attorney.
