CLEBURNE – A FedEx driver was attacked by two dogs while delivering packages Thursday. The driver was transported to Fort Worth’s Texas Health Harris Methodist Hospital. His condition is currently not known.
Sadly, “on the job” dog attacks are all too common. Since dog attacks are commonly reported in neighborhoods, it’s no surprise that postal workers and delivery men, law enforcement officers, animal control officers and utility workers are frequent victims of dog bites.
In recent years, the United States Postal Service has drawn attention to the problem by urging dog owners to keep their dogs restrained. Nationwide, an estimated 5,879 postal employees are attacked each year, and many are left with permanent disfigurement.
Similarly, the American Veterinary Medical Association established May 17-23 as National Dog Bite Prevention Week. During this time, they hope to educate dog owners about the importance of keeping your dog (even friendly ones!) restrained while answering the door, and to inform workers how to stay safe in neighborhoods.
Workers should know that they’re protected under Texas law if they’re attacked by someone’s dog while on the job. Texas allows workers to file a claim under the dog owner’s homeowner’s insurance policy to be reimbursed for medical bills, missed work days and other damages. It doesn’t matter that the worker was on someone else’s property – all dog owners have a responsibility to keep others safe from their dogs, regardless of where the attack occurs.
Similarly, even if a worker is covered under worker’s comp, they can STILL file a claim. Worker’s comp is notorious for underpaying employees who are hurt and typically only covers part of the lost wages. Also, worker’s comp doesn’t compensate hurt employees for pain and suffering, which is something all injured workers are entitled too. For this reason, if a worker is attacked by a dog while on the job, they should file a claim both through worker’s comp and also through the dog owner’s insurance policy to ensure they receive full compensation.
