Karen was a young mother driving down I-20 in Weatherford with her young child in the car seat. From the opposite direction, an 18-wheeler for Ben E. Keith was traveling eastbound on I-20. It had started to rain and most drivers slowed down due to the road conditions. The exception was the semi-truck driver who continued to drive at regular highway speeds.
A Big Rig Accident
As the 18-wheeler driver approached a bridge, he lost control of his rig and crashed through the grass median and into oncoming traffic – including our client and her child, both of whom were taken by ambulance to hospitals in Fort Worth.
Our client suffered a herniated lumbar disc and required a fusion. She also suffered an infection following the surgery and had to be hospitalized to treat the infection. Fortunately, the injuries to our client’s child were much less severe.
We filed a lawsuit against Ben E. Keith and the driver in Tarrant County. We were able to show that Ben E. Keith’s training of their young driver was wholly inadequate. After one unsuccessful mediation session, the case ultimately settled for a confidential amount less than a month prior to trial.
Resolved for a confidential settlement.
